Buying Property in Budapest as a Foreigner: How Does the Process Work, and Who Represents the Buyer?

Foreign nationals can buy apartments in Budapest, but finding the right property is only one part of the process. Understanding the local market, the legal and administrative requirements, and who represents the buyer's interests is equally important.

Buying property in Budapest as a foreigner – property search and purchase process

Understanding the market matters as much as finding the property

Budapest can be an attractive destination for foreign buyers looking for a home, a second residence or a property investment.

However, its districts, buildings and individual property markets can differ significantly.

At first, the process may appear straightforward: set a budget, identify suitable neighbourhoods and start browsing property listings.

In practice, the decision is more complex.

Two apartments of similar size and asking price may differ substantially in the condition of their buildings, maintenance costs, renovation requirements, rental potential and future resale prospects.

Without local knowledge, these differences can be difficult to assess.

1. Can foreigners buy property in Hungary?

Generally, yes. However, the requirements depend on the buyer's nationality, the type of property and the circumstances of the transaction.

Citizens of the European Union and European Economic Area may be subject to different rules from buyers who are nationals of other countries.

Certain non-EEA buyers may need an administrative permit to acquire residential property in Hungary. Agricultural land and some other property categories are subject to separate restrictions.

Before beginning the search, it is therefore sensible to establish:

  • The buyer's nationality and legal status.
  • The type of property they intend to purchase.
  • Whether an acquisition permit is required.
  • Which documents and administrative procedures will be necessary.

Permit requirements and any applicable exemptions should always be checked in relation to the individual transaction.

2. Where should a property search begin?

A successful property search does not necessarily begin with browsing listings.

It begins with understanding why the buyer wants to purchase a property.

The priorities for a Budapest apartment used a few weeks each year will differ from those for a long-term rental investment or a permanent home.

A useful buyer profile should establish:

  • The primary purpose of the purchase.
  • The total available budget, including acquisition costs.
  • Preferred locations and transport connections.
  • Required size, layout and condition.
  • Willingness to undertake renovation.
  • The intended purchasing timeline.
  • For investment properties, rental suitability and future resale considerations.

A clearly defined search profile does more than save time.

It also provides a consistent framework for comparing properties and assessing whether individual opportunities genuinely meet the buyer's objectives.

3. Who represents the buyer in the Hungarian property market?

This is one of the most important questions for international buyers unfamiliar with how the local property market operates.

In Hungary, residential properties are commonly advertised by their owners or by estate agents appointed to sell them.

The agent handling a listing typically works on behalf of the seller and is engaged to facilitate the sale of that property.

There is nothing inherently wrong with this arrangement. However, the role of a seller's agent is different from that of an independent buyer's representative.

A buyer's agent begins with the buyer's objectives rather than with a particular property that needs to be sold.

Depending on the agreed scope of services, buyer representation can include developing the search strategy, reviewing the available market, identifying suitable properties, arranging viewings, comparing alternatives, preparing an offer strategy and coordinating the purchasing process.

Budapest Buyer's Agent represents buyers exclusively and does not accept commissions from sellers.

This allows us to assess properties based on their suitability for the buyer, rather than on whether we have been instructed to sell them.

4. How can a buyer assess whether an apartment is fairly priced?

An asking price is not the same as market value.

In Budapest, average prices per square metre can be particularly misleading when used without context.

Even within the same district, substantial differences may exist between streets, buildings and individual apartments.

A meaningful comparison should consider:

  • The precise location.
  • The building's physical and financial condition.
  • Floor level, lift access, natural light and noise.
  • Layout and practical usability.
  • Property condition and required expenditure.
  • Genuine alternatives currently available to the buyer.

An apartment with a higher price per square metre may still represent better value if it has stronger underlying characteristics and requires less additional investment.

The more useful question is not simply whether an apartment is expensive.

It is what the buyer is getting for that price compared with the realistic alternatives.

5. What documents and checks are important before purchasing?

Legal due diligence is an essential part of buying property in Hungary.

The official land registry record, commonly referred to as the tulajdoni lap, provides important information about the registered owner and rights or encumbrances affecting the property.

However, reviewing the title record alone is not sufficient.

For condominium apartments, relevant documentation may include the condominium's deed of foundation, organisational and operational rules, available financial information and planned building works.

It may also be necessary to compare the official floor plan with the actual layout, review the legal status of previous alterations and assess the property's technical condition.

A lawyer can review the legal aspects of the transaction and prepare the required contractual documentation. Where technical concerns arise, a qualified building surveyor or another specialist may also be needed.

At Budapest Buyer's Agent, legal expertise is available from an early stage of the search. One of our founders, Dr István Tamus, is a practising attorney with extensive experience in property transactions.

6. How do offers and purchase contracts work in Hungary?

Once the buyer has identified a suitable property, the next step is usually to prepare an offer.

A well-considered offer should address more than the purchase price.

Payment arrangements, the proposed completion timeline, handover conditions and any relevant contingencies may also be important.

Hungarian property transactions frequently involve a contractual deposit known as foglaló.

This has specific legal consequences and should not be confused with an ordinary advance payment.

Before signing any binding document or transferring money, buyers should understand the legal and financial implications of their commitments.

A successful offer strategy is not always about achieving the largest possible discount.

For desirable properties, speed, certainty of financing and the overall terms of the transaction can be just as important.

After the sale and purchase agreement is signed, the transaction proceeds through the relevant financial, administrative and land registry procedures, followed by handover under the agreed terms.

7. What are the additional costs of buying property in Budapest?

The purchase price is only one component of the total acquisition cost.

Depending on the transaction, buyers may need to budget for:

  • Property acquisition duty, generally 4% for typical residential purchases, subject to applicable exemptions and reliefs.
  • Legal fees.
  • Land registry and administrative charges.
  • Permit applications and translations, where required.
  • Technical inspections and specialist assessments.
  • Financing and foreign exchange costs.
  • Renovation, furnishing and preparation for occupation.

For investment properties, ongoing ownership costs, maintenance, taxation, property management, vacancy and rental-related expenditure should also be considered.

Understanding the full cost of ownership helps buyers assess affordability and compare opportunities on a consistent basis.

8. Can foreigners buy an apartment in Budapest remotely?

Many stages of the property search and purchase preparation can be handled remotely.

Online consultations, detailed property presentations, preliminary document reviews and coordination with legal advisers can all take place before the buyer travels to Hungary.

Certain steps may also be completed through an appropriately authorised representative, provided the relevant legal and formal requirements are met.

Nevertheless, viewing a property in person remains valuable.

Natural light, street noise, the condition of common areas and the atmosphere of a neighbourhood cannot always be judged accurately from photographs or video tours.

For many international buyers, the most efficient approach is therefore to combine thorough remote preparation with a focused visit to view a small number of carefully selected properties.

A typical buying decision

Consider an international buyer comparing two apartments in Budapest.

The first has recently been renovated and looks particularly attractive in photographs. However, it is located in a building with only average maintenance standards and potentially significant upcoming repair costs.

The second apartment is less visually impressive but offers a more practical layout, better natural light and a better-maintained building.

The first property may create the stronger initial impression.

Yet the second may represent a better long-term purchase, depending on the buyer's objectives.

Making the right choice requires more than comparing two listings.

It requires understanding the legal, technical, financial and market circumstances behind each property.

This is an illustrative decision scenario, not a description of an actual client transaction.

Why can independent buyer representation be valuable?

For international buyers, local market knowledge, the ability to interpret information and the coordination of different professionals can all make a meaningful difference.

The purpose of independent buyer representation is not simply to arrange more property viewings.

It is to help the buyer identify appropriate alternatives, recognise potential risks and make a well-informed purchasing decision.

At Budapest Buyer's Agent, we begin with the buyer's objectives, not with properties we are trying to sell.

We believe good property decisions cannot be based on universal rules. Every buyer has different goals, resources and circumstances, which means the right property will not be the same for everyone.

Frequently Asked Questions

Can a foreigner buy an apartment in Budapest?

Yes. The requirements depend on nationality and the type of property. Some non-EEA nationals may require an administrative acquisition permit.

Do I need to live in Hungary to buy property?

Generally, having a Hungarian residential address is not a prerequisite for purchasing an apartment. Buyers must nevertheless meet the applicable identification, tax and administrative requirements.

Do I need a lawyer to buy property in Hungary?

The transfer of property ownership requires appropriate legal documentation and legal involvement in the land registration process. Working with an experienced Hungarian property lawyer is therefore an important part of the transaction.

Who pays the estate agent in Hungary?

In traditional seller-side estate agency arrangements, the seller usually pays the agent's commission. An independent buyer's agent works under a separate agreement with the purchaser and is compensated according to that agreement.

What additional costs should I expect when buying an apartment in Budapest?

Additional costs can include property acquisition duty, legal fees, administrative charges, any required permits and technical inspections. The total depends on the individual transaction.

Can I purchase property in Hungary without travelling there?

Several stages can be handled remotely, and representation by power of attorney may be possible. The relevant legal and formal requirements should be confirmed in advance.

Is it worth hiring a buyer's agent in Budapest?

Independent buyer representation can be particularly useful for international buyers who are unfamiliar with the local market, are searching from abroad or want professional support focused exclusively on their interests.
